Terms of Service

Welcome to Boost My Agent (the “Service”), operated by Webcafe Commerce LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of boostmyagent.com (the “Site”) and any content, products, or services we make available through the Site. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. License Access

Purchases and customer-only access are handled through your checkout email and Boost OS license key. You are responsible for keeping your license key confidential and for all activity tied to that key. Notify us promptly at team@mail.boostmyagent.com of any unauthorized use.

3. The Service

Boost My Agent sells digital “Boost OS” products: folders containing a SKILL.md file and supporting resources designed for use with AI coding agents that support the open Agent Skills format. Each Boost OS release is a single artifact that may be installed across one or more compatible platforms (for example, Cursor, Claude Code, Codex, GitHub Copilot, Replit, and Windsurf).

Boost OS products are instructions and reference materials intended to be loaded by third-party AI coding agents. We do not control, operate, or warrant any third-party agent, model, platform, API, or output. Any code, content, or action produced by an AI agent using Boost OS is the sole responsibility of the user and the third-party agent provider, not us. You are solely responsible for reviewing all output before relying on it, deploying it, or shipping it to production.

4. License; License Key; Anti-Abuse and Anti-Resale

When you purchase Boost OS, we issue you a single license key (in the format BMA-XXXX-XXXX-XXXX-XXXX) that grants you a non-exclusive, non-transferable, non-sublicensable, perpetual license to install and use Boost OS within your own development workflows and projects. The license key is issued to a single individual or single business entity (“Licensee”) and may not be sold, transferred, sublicensed, leased, lent, or shared with any other person or entity. Each Boost OS release may include additional license terms; those terms prevail to the extent of any conflict with these Terms.

License-key abuse and revocation. We monitor license-key activity to detect signs of unauthorized sharing or resale, including without limitation: simultaneous or near-simultaneous use from multiple unrelated IP addresses, use from geographically inconsistent locations within short time windows, public posting of a license key, automated or scripted credential stuffing against the redemption portal, or evidence of bulk redistribution of Boost OS files. We may, in our sole discretion and without prior notice, suspend or revoke any license key we reasonably believe to be subject to such abuse. Revocation does not entitle you to a refund and does not relieve you of liability for any prior violation of these Terms.

Unauthorized resale and redistribution. The unauthorized sale, resale, redistribution, mirroring, repackaging, or sublicensing of Boost OS — in whole or in part, with or without modification, and whether for compensation or free of charge — is strictly prohibited and constitutes a material breach of these Terms and an infringement of our intellectual-property rights. We reserve all rights and remedies available under law and equity, including without limitation injunctive relief, actual damages, statutory damages under the U.S. Copyright Act (17 U.S.C. § 504(c)) of up to $150,000 per work infringed for willful infringement, disgorgement of profits, and recovery of attorneys’ fees and costs (17 U.S.C. § 505). We may also report unauthorized distribution to platform hosts (including without limitation GitHub, npm, file-sharing services, and payment processors), pursue takedowns under the Digital Millennium Copyright Act and equivalent international laws, and refer matters to law enforcement where appropriate.

Verified source. The only authorized distribution channels for Boost OS are boostmyagent.com and the official npm package published by Webcafe Commerce LLC. Any copy of Boost OS obtained from any other source is unauthorized and unverified, and we make no representations or warranties of any kind regarding it.

Bulk and enterprise licensing. Bulk, team, and enterprise licenses are sold on a per-seat basis: each individual end user is issued a separate license key and is treated as a Licensee under these Terms. The customer of record (for example, the purchasing company) is responsible for assigning each key to a single named individual, for keeping an accurate record of those assignments, and for ensuring that no key is shared, transferred between individuals, or reused after an assigned individual leaves. The license-key abuse, revocation, and anti-resale provisions of this Section apply independently to each per-seat key. Bulk pricing, payment terms, and any additional enterprise terms must be agreed in a separate written order or quote signed by an authorized representative of Webcafe Commerce LLC; to inquire, contact us at the email listed in Section 21.

5. Payments and Refunds

Prices are stated on the Site at the time of purchase. All payments are processed by third-party payment providers, and you agree to their applicable terms. Boost OS products are digital goods delivered immediately upon purchase. We offer a seven (7) day risk-free refund window for direct purchases made through the Site. Our complete policy on refunds, the process for requesting a refund, license-key revocation, future-purchase restrictions after refund, and payment disputes are set out in our Refund Policy, which is incorporated into these Terms by reference.

6. Acceptable Use

You agree not to:

  • reverse-engineer the Service in a way that violates law;
  • introduce viruses, malware, or other harmful code;
  • interfere with or disrupt the Service or its infrastructure;
  • use the Service for any unlawful or fraudulent purpose;
  • attempt to access accounts or data that do not belong to you;
  • share, sell, transfer, sublicense, post, or otherwise disclose your Boost OS license key, or use a license key issued to another person or entity; or
  • republish, mirror, repackage, or distribute Boost OS files (in whole or in part) outside the authorized channels described in Section 4.

Acceptable AI Use. You further agree not to use Boost OS, the Service, or any AI-generated output produced with our materials to:

  • generate, distribute, or facilitate content that is illegal, defamatory, infringing, fraudulent, deceptive, or that violates the rights of any third party;
  • create, deploy, or distribute malware, ransomware, spyware, phishing materials, exploit code, surveillance or credential-harvesting tools;
  • generate sexual content involving minors, non-consensual imagery, or content that promotes violence, self-harm, or unlawful discrimination;
  • harass, threaten, impersonate, or invade the privacy of any person;
  • generate content used to mislead voters, manipulate elections, or engage in unauthorized practice of regulated professions (legal, medical, financial advice presented as authoritative);
  • circumvent or violate the terms of service, usage policies, or rate limits of any third-party AI agent, model, or platform; or
  • use the Service or its content to train, fine-tune, or evaluate any machine-learning model that competes with the Service, or to scrape, mirror, or republish Boost OS in bulk.

We may suspend or terminate access for any violation of this Section and may report unlawful activity to law enforcement.

7. Intellectual Property; Third-Party and Open-Source Components

The Service and all original content, including the Site design, source code, and our branding, are owned by Webcafe Commerce LLC and are protected by copyright, trademark, and other laws. Boost OS may incorporate content licensed from third parties; their respective owners retain all rights to that content.

Boost OS may include or reference third-party and open-source components (including, without limitation, code snippets, libraries, documentation, prompts, templates, images, and configuration files) that are made available under their own license terms (such as MIT, Apache 2.0, BSD, GPL, CC, or proprietary licenses). Where a license, NOTICE, or attribution file is included with Boost OS or referenced in its SKILL.md, that file governs your use of the corresponding component and prevails over these Terms with respect to that component. You are solely responsible for reviewing and complying with any such license, including attribution, copyleft, or source-disclosure obligations.

We do not represent or warrant that any bundled or referenced third-party content is free of license obligations, defects, or third-party claims. We disclaim all liability arising from your use of, or failure to comply with the license terms of, any third-party or open-source component included in or referenced by Boost OS. If you believe Boost OS misattributes or improperly bundles third-party content, contact us at team@mail.boostmyagent.com and we will review promptly.

8. Disclaimers; No SLA

THE SERVICE AND ALL BOOST OS PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY BOOST OS PRODUCT WILL ACHIEVE PARTICULAR RESULTS WHEN USED WITH ANY AI AGENT, MODEL, OR PLATFORM.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING ANY THIRD-PARTY AI AGENT, MODEL, OR PLATFORM (INCLUDING BUT NOT LIMITED TO CURSOR, CLAUDE CODE, CODEX, GITHUB COPILOT, REPLIT, OR WINDSURF), AND WE ARE NOT RESPONSIBLE FOR ANY ACT, OMISSION, OUTPUT, ERROR, LOSS, OR DAMAGE CAUSED BY OR RELATED TO ANY SUCH THIRD PARTY. ANY USE OF AN AI AGENT IS BETWEEN YOU AND THAT THIRD-PARTY PROVIDER.

No SLA, uptime guarantee, or support obligation. THE SERVICE IS NOT GOVERNED BY ANY SERVICE-LEVEL AGREEMENT. WE DO NOT GUARANTEE ANY MINIMUM AVAILABILITY, UPTIME, RESPONSE TIME, OR DELIVERY WINDOW. YOUR LICENSE INCLUDES ACCESS TO GENERALLY AVAILABLE BOOST OS UPDATES THAT WE CHOOSE TO RELEASE, BUT WE DO NOT GUARANTEE ANY PARTICULAR UPDATE, RELEASE SCHEDULE, SUPPORT LEVEL, MAINTENANCE WINDOW, OR CONTINUED COMPATIBILITY WITH ANY THIRD-PARTY PLATFORM. WE MAY MODIFY, SUSPEND, LIMIT, OR DISCONTINUE THE SERVICE OR ANY SKILL PACK AT ANY TIME, FOR ANY OR NO REASON, WITHOUT NOTICE OR LIABILITY. ANY SLA, UPTIME, OR SUPPORT COMMITMENT MUST BE AGREED TO IN A SEPARATE WRITTEN AGREEMENT SIGNED BY AN AUTHORIZED REPRESENTATIVE OF WEBCAFE COMMERCE LLC.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBCAFE COMMERCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Webcafe Commerce LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may stop using the Service at any time. Sections that by their nature should survive termination (including License, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

12. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Exclusive venue for any dispute arising from or relating to these Terms shall be in the state or federal courts located in San Francisco, California, and you consent to the personal jurisdiction of those courts.

13. Dispute Resolution; Binding Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in San Francisco, California (or remotely at the arbitrator’s discretion). Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver: you and Webcafe Commerce LLC agree to bring any dispute on an individual basis only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

You may opt out of this arbitration agreement by sending written notice to team@mail.boostmyagent.com within 30 days of first accepting these Terms. Notwithstanding this section, either party may bring an individual claim in small-claims court, or seek injunctive relief in a court of competent jurisdiction to protect intellectual-property rights.

14. Force Majeure

We will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including without limitation acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, internet or telecommunications outages, denial-of-service attacks, third-party provider failures (including AI model or hosting providers), or changes in law.

15. Severability; Waiver; Entire Agreement

If any provision of these Terms is held to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with any policies referenced herein and any additional terms accepted by you, constitute the entire agreement between you and Webcafe Commerce LLC regarding the Service and supersede any prior agreements.

16. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms at any time without notice or consent, including in connection with a merger, acquisition, or sale of assets.

17. No Agency

Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Webcafe Commerce LLC.

18. Electronic Communications and Notices

By using the Service, you consent to receive communications from us electronically (by email or by posting on the Site), and you agree that such electronic communications satisfy any legal requirement that they be in writing.

19. DMCA / Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act (DMCA) to team@mail.boostmyagent.com. We will respond to valid notices and may remove or disable access to content alleged to be infringing.

20. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent version. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
